(iii) your distribution of malware or harmful code; or (iv) your violation of any third-party rights (including intellectual property rights).
CMD reserves the right, at your expense,
to assume exclusive control of the defense and settlement of any matter subject to indemnification, and you agree to cooperate with the defense.

These Terms of Use and any dispute arising out of or relating to the website shall be governed by the laws of the State
of California, without regard to conflict-of-law principles.
Any legal action or proceeding relating to these Terms of Use or the website shall be brought exclusively in the state
courts located in Los Angeles County, California, or, where federal jurisdiction applies, the United States District
Court for the Central District of California, and you consent to such jurisdiction and venue.
15. Severability and Waiver
If any provision of these Terms of Use is held invalid or unenforceable, the remaining provisions will remain in full
force and effect. A failure by CMD to enforce any provision shall not be deemed a waiver of that provision or of the
right to enforce it later.
